Terms and Conditions

These Terms and Conditions apply when you access or use the BeCareers website, platform, products, and related services (the Platform). Update all items in square brackets before publishing.

1. About us

BeCareers is run by Human Advertising. This company is registered in England and Wales. The company number is 07455860. Its registered office is at 22 Queens Road, Doncaster DN1 2NQ, South Yorkshire.

References in these Terms to “BeCareers”, “we”, “us” or “our” mean the company above.

2. Acceptance of these Terms

By accessing or using the Platform, creating an account, posting a vacancy, applying for a role, using any AI screening feature, or otherwise interacting with our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

If you use the Platform on behalf of a company or organisation, you confirm that you have their authority to accept these Terms on their behalf.

3. Who may use the Platform

You may use the Platform only if you meet all these rules: You are at least 18 years old. You can enter into a legally binding contract. You follow these Terms and all laws. We may refuse access to the Platform where we reasonably believe a user does not meet these requirements.

4. The Platform

BeCareers provides recruitment technology and services. These may include job discovery and advertising, candidate profiles, employer access tools, AI screening, chatbots, dashboards, analytics, and support.

BeCareers is a technology platform. Unless expressly stated otherwise in writing, we are not:

  • a. An employer in relation to any vacancy listed on the Platform;
  • b. A party to any employment contract between an employer and a candidate; or
  • c. Responsible for hiring decisions made by employers.

5. Accounts and account security

To use some parts of the Platform, you may need to create an account.

You agree to provide correct and complete information. Keep your login details safe and confidential. Update your information if it changes. Tell us right away if you think someone has used your account without permission.

You are responsible for all activity carried out through your account unless caused by our failure to maintain appropriate security.

We may suspend or deactivate your account if we believe you have violated these Terms or that your use creates legal, security, or reputational risk.

6. Candidate terms

If you use the Platform as a candidate, you agree that:

  • a. All information, CVs, profiles, qualifications, work history, right-to-work details, or other materials you give must be correct and not misleading.
  • b. You will only apply for roles genuinely of interest to you;
  • c. You will not impersonate another person or submit false documents;
  • d. You are responsible for the content of your application and interview responses; and

Employers, not BeCareers, make recruitment decisions, conduct interviews, and extend offers and employment terms.

You acknowledge that submitting an application through the Platform does not guarantee an interview, offer, response or employment.

7. Employer terms

If you use the Platform as an employer, recruiter, or hiring group, you agree to the following:

  • a. You will use the Platform only for genuine recruitment and hiring-related purposes;
  • b. All vacancies, adverts and communications must be lawful, accurate and not misleading;
  • c. You are only responsible for your hiring decisions, candidate management, and compliance with employment, equality, immigration, and data protection laws.
  • d. You will not discriminate unlawfully in advertising, screening or hiring;
  • e. You will not use Platform data to spam, harass or unlawfully profile candidates; and
  • f. You will only access candidate information to the extent reasonably necessary for recruitment purposes.

8. AI screening and automated tools

The Platform may have AI tools such as chat screening, video or voice interviews, summaries, transcripts, ranking, keyword matching, recommendations, or workflow automation. These AI tools may have limitations and may not always produce accurate or reliable results.

Using these features means you accept that AI outputs are automatic. They may have errors, omissions, bias, or be wrong. AI helps, but does not replace, human judgment. Employers must review candidates and make choices. Candidates must answer truthfully and fully.

We may process submitted responses, recordings, transcripts and related data in accordance with our Privacy Policy.

Where employers use AI-assisted tools in ways that could have legal or similarly significant effects on individuals, they are responsible for ensuring appropriate human oversight and compliance with applicable laws.

9. User content

You retain ownership of the content you submit to the Platform, including job adverts, profiles, CVs, interview answers, recordings, messages and other materials (User Content).

You allow BeCareers to use your User Content. This includes hosting, storing, reproducing, processing, adapting, showing, and sharing the content. This is needed to run and improve the Platform, provide you services, show jobs and candidate details to employers, create transcripts, summaries, analytics, screening, or follow legal rules.

You confirm that you own or control your User Content. It does not break anyone else’s rights. It is legal and not defamatory, abusive, obscene, or misleading.

We may remove or restrict User Content that we reasonably believe breaches these Terms or applicable law.

10. Fees, subscriptions and payment

This clause applies where you purchase a paid plan, subscription or other paid service from us. We will describe fees, payment schedules, limits, renewals, and any trial offers on the Platform, or in a form, proposal, or other written terms.

Unless stated otherwise:

  • a. Fees are exclusive of VAT and any applicable taxes.

Unless we say so, fees do not include VAT or taxes. Paid subscriptions renew for the same time period unless you cancel before renewal. Fees are non-refundable, except where the law or we state otherwise. We may stop your paid services if you owe money.

We may change pricing for future billing periods by giving reasonable notice.

11. Acceptable use

Do not use the Platform in illegal or dishonest ways, or upload harmful material. Do not take or use data except as allowed. Do not disrupt the Platform. Do not try to copy or access its source code unless the law lets you. Do not use it to send spam, pretend to be someone else, or post offensive or illegal content. Only use candidate data for real hiring needs.

12. Intellectual property

BeCareers owns or has rights to all intellectual property in the Platform. This includes software, design, text, graphics, databases, and more.

You must not copy, change, share, sell, rent, give away, or use any part of the Platform unless these Terms say you can, or you have our written consent.

Nothing in these Terms transfers ownership of our intellectual property to you.

13. Privacy and data protection

We process personal data as described in our Privacy Policy and, if relevant, our Cookie Policy.

Depending on how you use the Platform, BeCareers may be a controller, processor, or independent controller for different types of personal data. Employers must have a legal basis for collecting and using candidate data through the Platform.

If required, the parties will enter into a separate data processing agreement.

15. Availability and changes to the Platform

We may update, change, pause, or stop any part of the Platform at any time.

We do not promise that the Platform will always be on, run without interruption, be secure, or be error-free.

We may carry out maintenance, updates, security work or changes to improve the Platform.

16. Suspension and termination

We may suspend or terminate your access to the Platform immediately if:

  • a. You materially breach these Terms;
  • b. You fail to pay fees when due;
  • c. We reasonably believe your use creates legal, regulatory, security or reputational risk; or
  • d. We are required to do so by law.

You may stop using the Platform at any time. For paid subscriptions, cancellation rights are subject to the applicable billing terms.

Clauses intended to survive termination, including those on payment, intellectual property, liability, confidentiality and governing law, will continue after termination.

17. Disclaimers

The Platform is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, BeCareers does not guarantee:

  • a. That any vacancy will be filled;
  • b. That any candidate will be suitable, available or successful;
  • c. That employers will contact or hire candidates;
  • d. That AI-generated outputs will be complete, accurate or fit for any particular purpose; or
  • e. That the Platform will be uninterrupted, secure or free from defects.

Recruitment outcomes depend on many factors outside our control, including employer criteria, candidate quality, market conditions and user conduct.

18. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Subject to the paragraph above, BeCareers shall not be liable for:

  • a. Any indirect or consequential loss;
  • b. Loss of profits, revenue, business, goodwill, opportunity or anticipated savings;
  • c. Loss or corruption of data; or
  • d. Hiring decisions, employment disputes, workplace conduct, or the acts or omissions of employers, candidates or third parties.

Subject to the first paragraph of this clause, our total aggregate liability arising out of or in connection with these Terms shall not exceed:

  • a. Where you are a paying customer, the total fees paid by you to us in the 12 months before the event giving rise to the claim; or
  • b. Where you are not a paying customer, £100.

19. Indemnity

If you are an employer or other business user, you agree to indemnify and keep indemnified BeCareers against losses, claims, liabilities, damages, costs and expenses arising from:

  • a. Your breach of these Terms;
  • b. Your job adverts, candidate communications or hiring decisions;
  • c. Your misuse of candidate data; or
  • d. Your breach of applicable law.

20. Changes to these Terms

We may update these Terms from time to time.

Where changes are material, we will take reasonable steps to notify users, for example by posting an update on the Platform or by email. Continued use of the Platform after updated Terms take effect constitutes acceptance of the revised Terms.

21. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No failure or delay by us in exercising any right shall operate as a waiver of that right.

These Terms do not create any partnership, agency, employment or joint venture relationship between you and BeCareers.

A person who is not a party to these Terms shall have no right to enforce them except where expressly stated.

22. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except where mandatory consumer law provides otherwise.
